Terms & Conditions - the basics

1. Definitions

  • "Company," "We," "Us," "Our": Refers to SM Photography & Videography, based in Hyderabad, Telangana, India.

  • "Client," "You," "Your": Refers to the person, organization, or entity booking or purchasing services from us.

  • "Services": Refers to photography, videography, editing, and cinematic production services provided by the Company.

2. Bookings, Payments, and Pricing

  • Pricing: All service rates listed on our website (including Event Photography, Portrait Shoots, and Wedding Videography) are subject to change. Final quotes will be confirmed at the time of booking.

  • Booking Fees / Retainers: A non-refundable booking fee or advance payment may be required to secure your specific date and time slot.

  • Balance Payment: The remaining balance for any media services must be cleared in accordance with the payment schedule agreed upon prior to or on the day of the event. We accept payments via the methods specified during the checkout/booking process.

3. Cancellation, Rescheduling, and Refunds

  • Client Cancellations: If you cancel a confirmed booking, any initial non-refundable retainers will be forfeited.

  • Rescheduling: Requests to change a session date must be made as early as possible. While we will make every effort to accommodate changes, rescheduling is subject to our team's availability and may incur a rescheduling fee.

  • Company Cancellation: In the highly unlikely event that we must cancel due to extreme unforeseen circumstances (e.g., illness, emergency, equipment failure), we will notify you immediately and issue a full refund of all amounts paid.

4. Intellectual Property and Copyright

  • Ownership of Media: SM Photography & Videography retains the full copyright of all photographs, raw footage, and final edited videos captured during the assignment, as protected under Indian Copyright Laws.

  • Client Usage Rights (Personal License): Upon final payment, the Client is granted a non-exclusive, perpetual license to download, print, copy, and share the final edited digital files for personal, non-commercial use.

  • Commercial Use: If the services are for a commercial project (such as Promotional Video Production), the specific commercial distribution rights must be agreed upon in writing.

  • Promotional Right: Unless expressly requested otherwise in writing by the Client, the Company reserves the right to use final images and videos in our portfolio, website, social media, and advertising materials to demonstrate our work.

5. Client Responsibilities and Co-operation

  • Venue Permissions: The Client is responsible for securing any necessary permissions, permits, or passes required for the photographers/videographers to shoot at chosen locations or venues.

  • Timeline and Delays: The client agrees to stick to the agreed schedule. We cannot be held responsible for missed shots or shortened coverage if an event runs late or key individuals are unavailable.

6. Limitation of Liability

  • Equipment and Data Failure: We utilize professional-grade cameras, audio gear, and dual-slot backup systems. However, in the rare event of technical failure, digital data loss, or transport accidents, our total liability is strictly limited to a refund of the amount paid by the Client for the affected service.

  • Artistic Discretion: The final output, editing style, color grading, and creative choices are at the professional artistic discretion of SM Photography & Videography.

7. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of India, and any disputes relating to these terms will be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana.

8. Changes to These Terms

We reserve the right to modify these Terms and Conditions at any time. Any changes will be posted directly to this page with an updated modification date.
